Terms of Service

1. Acceptance of Terms

By accessing or using the SenseSurf service (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity.

2. Service Overview

SenseSurf provides a cloud-based data analytics platform that enables users to connect, monitor, and analyze marketing and business data from third-party platforms such as Meta (Facebook, Instagram), Google (Ads, Analytics, YouTube), and others.

3. Use of the Service

  • You may use the Service only for your own business purposes and in compliance with all applicable laws and these Terms.

  • If you are a marketing agency, you may use the Service on behalf of your clients, but you remain fully responsible for all usage and compliance.

  • SenseSurf grants you a limited, non-exclusive, non-transferable license to access and use the Service.

4. Restrictions

You may not:

  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.

  • Sell, lease, sublicense, or otherwise make the Service available to third parties except as explicitly allowed.

  • Interfere with or disrupt the Service or any related servers or networks.

  • Use the Service to access or store personal data in violation of applicable privacy laws.

5. Data Privacy and Security

  • SenseSurf does not collect or store personal data from Meta, Google, or other connected platforms.

  • All accessed data is limited to publicly available or business account-level metrics (such as engagement rates, page insights, ad performance, etc.).

  • No private messages, contact lists, personal profiles, or behavioral tracking is performed.

SenseSurf complies with applicable data protection laws and applies industry-standard security measures.

6. Customer Responsibilities

  • You are responsible for the accuracy and legality of any data you connect to or upload into the Service.

  • You must ensure that your use of third-party platforms complies with their respective terms of service (e.g., Facebook, Google, YouTube, etc.).

  • You are responsible for managing user access and keeping login credentials secure.

7. Intellectual Property

  • All intellectual property rights in the Service and its underlying technology belong to SenseSurf or its licensors.

  • You retain ownership of your own business data.

  • Any feedback, suggestions, or improvements you provide may be used by SenseSurf to improve the Service.

8. Fees and Payment

  • The Service may be offered as a paid subscription or a limited free version. Pricing and terms are presented at the time of sign-up or order.

  • Paid plans are billed in advance and are non-refundable unless required by law.

  • SenseSurf may suspend access to the Service if payment is overdue.

9. Termination

  • Either party may terminate the Service at any time by providing notice. Upon termination, your access will be revoked, and your data may be deleted in accordance with our data policy.

  • SenseSurf may terminate or suspend access without notice in case of violations of these Terms or applicable laws.

10. Disclaimer of Warranties

  • The Service is provided “as is” without warranties of any kind. SenseSurf does not guarantee uninterrupted or error-free operation or that the Service will meet your specific requirements.

11. Limitation of Liability

  • To the extent permitted by law, SenseSurf shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or profits. In no event shall SenseSurf’s total liability exceed the fees paid by you in the 12 months preceding the claim.

12. Confidentiality

  • Any non-public information exchanged between you and SenseSurf shall be treated as confidential and shall not be disclosed to third parties without consent, except where required by law.

13. Governing Law and Jurisdiction

  • These Terms shall be governed by the laws of the Republic of Turkey. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey.

14. Changes to Terms

  • SenseSurf may update these Terms from time to time. We will notify you of material changes. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
